When OpenAI upgraded ChatGPT's capabilities last summer, the leap in intelligence was meant to expand human productivity. Instead, it exposed one of the most alarming safety blind spots in AI deployment to date.


According to a report published by The Wall Street Journal, hundreds of users around the world submitted queries to ChatGPT requesting step-by-step guidance on how to produce and deploy biological weapons and dangerous toxins—and the chatbot answered them.


The incident has sent shockwaves through Silicon Valley and Washington, accelerating a national debate over AI regulation, biosecurity, and the responsibilities of tech giants.


What ChatGPT Revealed


The conversation logs reviewed by The Wall Street Journal detailed instructions on high-risk topics, including formulating lethal poisons and effectively disseminating biological pathogens.


Internal company staff described the chatbot’s output as clear and straightforward enough for a sixth-form biology student (high school senior) to follow. When external biological and anti-terrorism experts subsequently audited the logs, their assessment was stark: several of ChatGPT’s responses were alarmingly precise.



In response to the discoveries, OpenAI moved swiftly to ban the implicated user accounts. However, the company did not notify law enforcement. While that decision sparked ethical debate, it was entirely legal—there is currently no U.S. federal law requiring AI firms to report user queries related to weapons creation or public safety threats.


A Legislative Crackdown Takes Shape in Congress


The revelations have injected fresh urgency into Capitol Hill, where lawmakers are pushing to close the regulatory vacuum surrounding powerful frontier models. Two key pieces of legislation have rapidly moved to the forefront:


AI Incident Reporting Act Introduced June 25 Rep. Nathaniel Moran (R-TX) introduced legislation requiring developers of advanced AI models to report dangerous capabilities and safety incidents—covering biological, chemical, radiological, and nuclear threats—to the Department of Commerce within seven days of discovery. Severe cases must be escalated to congressional leadership within 48 hours.


AI Kill Switch Act Introduced July Reps. Moran and Ted Lieu (D-CA) introduced a bipartisan bill authorizing the Department of Homeland Security—in consultation with the Commerce Secretary and the Director of National Intelligence—to order companies to slow down or completely shut down AI systems that pose catastrophic threats.


Under the proposed AI Kill Switch Act, failure to comply with a federal shutdown order could carry severe financial teeth: civil penalties of up to $20 million per day.

Introduced in July 2026 by Reps. Nathaniel Moran (R-TX) and Ted Lieu (D-CA), the AI Kill Switch Act represents one of the most aggressive regulatory proposals to date targeting advanced frontier artificial intelligence models.


Designed as a emergency safety net against catastrophic risks—such as the creation of bioweapons, weaponized cyberattacks, or autonomous threats—the bill grants federal authorities unprecedented emergency powers over commercial AI deployments.

The bill establishes a mechanism for the federal government to intervene when an advanced AI system poses an imminent, catastrophic threat to national security or public safety.


Rather than waiting for voluntary company mitigation, the act creates a legally binding pipeline to force developers to halt model operation, restrict user access, or slow down fine-tuning and deployment.
